CANDIDATE Q&A: 14th Circuit Judge

Jim Fensom
   Current occupation:    Circuit judge
   Relevant experience:    Improvements in timely protection of children. The fair, efficient and prompt resolution of all cases with the proper application of the law. Extensive jury trial experience as a lawyer in criminal law including murder, sexual battery, DUI manslaughter, robbery, kidnapping and battery. Civil jury trial experience in accidental death cases, medical malpractice, construction and products liability. The valuable lessons learned as an attorney presenting oral arguments in the Florida Supreme Court and other appellate courts.
   Platform: I have proven my abilities in over 38 years of legal experience. In handling cases with at-risk children the time for resolution of cases was reduced by one-half. Of the 50 jury trials over which I have presided, only one has been reversed for a new trial due in large part to my years of experience as a lawyer trying over 100 jury trials.
   What do you see as the biggest issue in your race? The tremendous benefit of having many jury trials of complex civil and criminal cases combined with a large number of cases handled in the higher courts. I draw on this experience every day to assist me in reaching fair and timely decisions that will be final and correct. The jury trial ability of the judge should at least equal that of the lawyers in the courtroom.
   What do you see as the greatest challenge you would face if elected/reelected, and how would you deal with it?    The fair and efficient administration of justice is always the primary goal. Our greatest challenge is addressing the problem of drug and alcohol abuse. I make every attempt to assist the addicted person in overcoming their addiction. Having options available to assist the person is critical. Many of those addicted, with the proper help, can solve their drug problem and avoid prison. For dealers and others, prison may be the only option.
   Why do you deserve to be elected/re-elected? I have a proven track record of fairness and competence as one of your circuit judges. I am a trial judge. My docket consists of 16 trial weeks per year and is properly and timely managed. The constitutional right to a jury trial must be preserved by judges with substantial jury trial experience. The Florida Supreme Court recognized the dramatic improvements we made during my five years of working with abused and neglected children.

   Shalene Grover  
  Current Occupation:    Attorney
   Relevant experience:    I have represented thousands of people all across Northwest Florida. I have tried hundreds of trials including criminal, civil and family law. I have tried both jury and bench trials. I attend court several times each week. In addition, for the past 13 years I have been the county attorney representing the Liberty County Board of County Commissioners. I represent them on a variety of issues including constitutional compliance and employment law.
   Platform: As I practice throughout the circuit, I see several issues that need improvement. I believe that it is critical that all of us have timely access to our court system. Sometimes it can take six months just to get a court hearing. That means a person’s life is on hold. I think we can do better than that. It is also important that a judge have the correct judicial temperament. It is critical that people be treated with courtesy, dignity and respect.
   What do you see as the biggest issue in your race? I believe that a person’s temperament is the most important trait to consider when selecting a judge. No matter a person’s background or experience, they must have the ability to process cases effectively and efficiently. I have the right temperament. I can be tough without being rude. I can deal with difficult people without becoming a bully. I can show compassion when appropriate. I will apply the law and use common sense.
   What do you see as the greatest challenge you would face if elected/ re-elected, and how would you deal with it? The caseload for circuit judges is large and challenging. My extensive legal background and temperament will assist me in processing cases in a timely manner. I believe in being accessible, knowledgeable and willing to listen.
   Why do you deserve to be elected/ re-elected? I believe that a judge should be a devoted public servant dedicated to the pursuit of justice. I believe that I am the best judicial candidate due to my broad and extensive legal background, my strong and reasonable temperament, and my willingness to work hard to process cases efficiently. I recognize your case is important to you and to your family.
